1. Acceptance

By accessing https://examstack.in, creating an account, purchasing a plan, using a SaaS workspace, uploading content, or using ExamStack services, you agree to these Terms and Conditions, the Privacy Policy, the Refund Policy, and any plan-specific or institute-specific terms shown at purchase or activation.

2. Accounts and Eligibility

• You must provide accurate account information and keep login credentials confidential.
• Students under 18 should use the platform with parent, guardian, or institute authorization where required.
• Institute owners are responsible for their workspace users, role permissions, teacher/admin access, student records, parent links, and uploaded materials.
• We may suspend or restrict accounts for security risk, non-payment, fraud, abuse, unlawful use, or material breach of these terms.

3. Educational Content

ExamStack provides MCQs, mock tests, notes, current affairs, AI study assistance, exam pages, public institute profiles, and analytics for preparation and education support. Official exam notifications, eligibility, dates, syllabus, vacancies, answer keys, counselling, admission, and recruitment decisions must always be verified from the relevant authority.

4. Subscriptions, Payments, and Taxes

• Paid plans provide access to the features, limits, users, billing cycle, and duration shown at checkout, invoice, or subscription activation.
• Payments may be processed through Razorpay or another configured provider. Checkout, payment method authentication, bank processing, refunds, and chargebacks may be governed by the payment provider and banking network rules.
• Prices may include or exclude taxes as shown at purchase. GST details, if applicable, should be provided before invoice generation. GSTIN: Shown on the tax invoice where applicable.
• We may correct pricing, plan, or billing errors prospectively. Access may be paused for failed, reversed, disputed, or unpaid transactions.

5. Refunds and Cancellations

Refunds and cancellations are governed by the Refund Policy displayed on ExamStack and any written enterprise or institute agreement. Digital content, AI credits, downloaded files, mock-test access, and institute setup work may be non-refundable once substantially used or delivered unless applicable law requires otherwise.

6. Acceptable Use

• Do not scrape, copy, sell, redistribute, leak, or bulk export ExamStack content except through permitted product exports.
• Do not upload malware, infringing material, illegal content, personal data you are not authorized to process, or content that violates exam integrity.
• Do not bypass limits, manipulate ranks or attempts, share paid access outside permitted users, interfere with platform availability, or reverse engineer private APIs.
• Do not use AI features to generate harmful, illegal, deceptive, defamatory, or exam-cheating content.

7. Content Ownership and User Content

ExamStack and its licensors own the platform, design, software, questions, explanations, notes, articles, branding, analytics methods, and other materials unless otherwise stated. You receive a limited, revocable, non-transferable right to use the platform for learning or institute operations.

You retain responsibility for materials you upload or create. You represent that you have the rights and permissions needed to upload, process, publish, assign, or share that material through ExamStack.

8. Institute Workspaces

Institute owners control their workspace records and are responsible for notices, permissions, consents, role assignments, parent/guardian communications, student imports, attendance policies, public profile accuracy, and legal compliance for their own institute operations.

ExamStack may process institute data to provide hosting, support, security, analytics, backups, AI/OCR features, notifications, and other services described in the Data Processing Terms.

9. Public Profiles, Reviews, and Leaderboards

Public leaderboards, institute profiles, reviews, badges, rankings, and reputation signals are informational and may change after moderation, duplicate checks, recalculation, abuse review, privacy settings, or technical corrections. We may remove misleading, unlawful, spam, abusive, or privacy-invasive public content.

10. Third-Party Services

ExamStack may integrate with payment, email, WhatsApp, SMS, push, storage, AI, OCR, OAuth, analytics, hosting, and other providers. Their own terms and privacy practices may apply to your use of those services through ExamStack.

11. Service Changes and Availability

We may update features, limits, plans, pricing, user interfaces, routes, APIs, providers, policies, and content to improve ExamStack, address compliance, or maintain security. We may pause access for maintenance, incidents, legal requests, emergency controls, or provider outages.

12. Disclaimers and Liability

ExamStack is provided on an as-is and as-available basis to the maximum extent permitted by law. We do not guarantee exam selection, rank, admission, recruitment, score improvement, uninterrupted availability, or error-free content. Nothing in these terms limits liability that cannot be excluded under applicable law.

13. Governing Law and Disputes

These terms are governed by the laws of India. Before starting formal proceedings, please contact us with the relevant account, payment, institute, or support details so we can attempt to resolve the issue. Consumer rights available under applicable Indian law remain unaffected.

14. Updates

We may update these terms from time to time. Continued use after an update means you accept the updated terms, unless applicable law requires a different process.
